The Civil Mechanism for New Plant Varieties -A comparative study-

Abstract

With no doubt, recently the prominence of varieties of plants has been increased significantly in the aspect of biotechnology pertaining to agriculture production, and it has been operationalized. This has led to derivation new varieties of plants with specific characterization in which need to be protected. Protection of new varieties of plants through Intellectual property rules is not sufficient so that many Arabic developing countries including Iraq have adopted international criteria to protect new varieties of plants, but these countries have faced problems to fulfill their international obligation. For this reason, it is necessary to have convenient legal mechanism to protect new varieties of plants which impose an obligation on producer to provide sufficient information for customers to avoid any predicted health concern.
