Qafeez al-Tahhan and its jurisprudential Applications- a comparative jurisprudential study-
Abstract
The jurists differed about the hadith of Qafiz-al-tahan, which is the prohibition of giving wheat to the miller with part of the flour that he grinds. From the apparent, and they argued by analogy with watering and farming that the Prophet, may God bless him and grant him peace, treated the people of Khaybar with half of what came out of it, while the Malikis went to detail, that is: if what comes out was known at the time of the contract, they permitted it, and if what came out was unknown at the time of the contract they prevented it for ignorance with a fee.
