الملخص
الفقهاء غیر متفقین على وضع معیار معین یمکن الرکون الیه لتمییز محل العقد عن محل الالتزام الناشئ عن العقد لاسیما وان بعضهم نظر إلى العقد لتحدید محله فجعل محله أثرهُ وهذه اشکالیة وبعضهم الآخر جعله محل الالتزام نفسه ... الخ وهذه بلا شک اشکالیة بین الفقهاء فی تحدید محل العقد ومحل الالتزام الناشئ عن العقد، لذا جاء هذا البحث لمناقشة وتحلیل النصوص القانونیة وبیان مدى إمکانیة تطبیقها على الموضوع محل الدراسة فی القانون المدنی العراقی والقوانین المقارنة مع تلک الأحکام التی أرساها الفقه الإسلامی حوله بهدف الوصول إلى اقتراح نصوص قانونیة تعالج أحکام الموضوع محل الدراسة فی القانون المدنی العراقی.
