الملخص
یعتبر الغصب أحد الموضوعات الرئیسیة المهمة لأنه یتسبب فی حرمان صاحب العقار أو مالک حق سلطاته من الملکیة أو الحق حیث یؤثر على مبدأ استقرار المعاملات المالیة کما أنه یضر بالآخرین حقوق. وبالتالی ، فإن الفقه الإسلامی بجانب القانون المدنی العراقی یولی اهتمامًا کبیرًا للمحافظة على النوایا الخمسة ، أی الحفاظ على الدین والروح والعقل والذریة والممتلکات التی یتم من خلالها تحقیق فوائد البشر وحمایتهم من الأذى وأی شیء یفسد حیاتهم . للحفاظ على الممتلکات من الاغتصاب أو الخسارة ، فإننا نقترح قواعد تحظر الاغتصاب وردع أی شخص یعتزم الاستیلاء على ممتلکات الآخرین دون أی سبب قانونی.
