( /321/933 ), , , , . , .The present research deals with the analysis of lawful formula followed by the seditionists in the documentation of land reclamation in Islam depending on the document of Feudalities and land Reclamation included in a type of Fiqh books these books of conditions deal with the formulation of contracts and their documentation which were meant to be an application evidence for the book of justice. They included many forms of contracts which shows the relationship between Islamic Fiqh and the reality of life. Abu-Ga'far AL-Tahawi (321 H, 933 A.D) provided sample models of contracts in his book " The small Condition", on deals with legal framework of land reclamation in Islam, either with permission from the authority, which is common, or without authorization. The model provided by AL- Tahawi included the legal mechanism for the documentation of land reclamation. This model was followed in the early Islamic periods at least at the fourth Higrate century.
